Today's
New York Times reported the U.S. Supreme Court's decision in
New York State Board of Elections v. Lopez Torres upholding this state's "unique" system of nominating state court judges. Quoted in the article was the following passage from Justice Stevens' concurring opinion:
But as I recall my esteemed former colleague, Thurgood Marshall, remarking on numerous occasions: "The Constitution does not prohibit legislatures from enacting stupid laws."
I knew that, but what a pleasant reminder.
